konker provider agreement
Last updated: 28 September 2026
1. Parties and definitions
1.1 This Agreement is between Moup Group Limited, trading as Konker, a company registered in England & Wales (company number 17257983), of 5 Brayford Square, London, E1 0SG (“Konker”, “we”, “us”), and the activity provider, venue or brand named on the relevant order (“Provider”, “you”).
1.2 “Service” means the Konker mobile application and the discovery platform through which parents browse children's activities. “Listing” means a Provider's entry on the Service. “Fees” means the amounts set out in clause 4.
1.3 This Agreement applies in addition to — not instead of — our general website Terms of Service and Privacy Notice, which continue to govern anyone using the Service. Where this Agreement and the general Terms of Service conflict on a point relevant to your paid Listing, this Agreement takes priority.
2. The Service we provide
Konker is a discovery and advertising platform. Depending on the tier you sign up for, we offer:
-
Listed — a single static listing per location, including your booking/website link, age range and price. One-off fee, no ongoing management.
-
Pro — an editable listing covering up to 5 locations, with full contact details, photos and ongoing control over your content. Monthly subscription.
-
Advanced — unlimited locations plus session availability where supported. Monthly subscription.
-
Boost — a fixed-term top-placement slot for a single listing, purchased per use.
-
Brand Spotlight — a guaranteed placement in the app's home-feed carousel for an agreed term.
2.1 The specific tier, locations, and term you've signed up for are set out in your order confirmation or the Payment Link/invoice you accepted, which forms part of this Agreement.
3. What Konker does not do
3.1 Konker does not process bookings or take payment on your behalf for your own activities, classes or events. The Service links parents through to your own website or booking channel to complete any booking or purchase directly with you.
3.2 You remain solely responsible for the activities, services, venues and content you provide, including their safety, suitability, staffing, insurance, and compliance with all applicable law (including safeguarding requirements relevant to activities involving children). Konker is not a party to, and accepts no liability arising from, the booking or delivery of your activities.
3.3 If you're on the Advanced tier, session availability shown on your Listing is drawn from data you provide or connect to us; you're responsible for the accuracy of that feed.
4. Fees and payment
4.1 Listed is a one-off fee per location, charged at the time of listing. Pro and Advanced are billed monthly in advance by recurring card payment via our payment processor (Stripe) until cancelled. Boost is charged per purchase at the time you buy it.
4.2 Current Fees are shown on our pricing page and/or the order you accept, and may include a time-limited introductory or founding rate as described in clause 4.4.
4.3 VAT. Fees are shown exclusive of VAT. Konker is not currently VAT-registered, so no VAT is added to Fees at present. If Konker becomes VAT-registered, VAT will be added to Fees at the prevailing rate from a date specified in advance notice to Providers, in line with clause 4.5.
4.4 Launch/founding rates. Introductory or founding-rate pricing shown on our pricing page is available for a limited period, as stated on our pricing page.
4.5 Fee changes. We may change our Fees for future billing periods by giving you at least 30 days' written notice by email to the address on your account. Continuing to use a paid tier after a Fee change takes effect means you accept the new Fee; if you don't agree, you may cancel under clause 5.
4.6 All Fees are payable in full and, except as required by law or expressly stated in this Agreement, are non-refundable once charged.
4.7 If a payment fails, we may suspend your paid features until the issue is resolved.
5. Term, renewal and cancellation
5.1 Listed and Boost are one-off purchases with no ongoing term. Pro and Advanced continue on a rolling monthly basis from your sign-up date until either party ends them.
5.2 You may cancel Pro or Advanced at any time; cancellation takes effect at the end of the billing period you've already paid for, and we don't provide refunds for the unused portion of a current period.
6. Ending this Agreement
6.1 We may suspend or end your access to a paid tier immediately, without notice, if you provide false, misleading or unsafe information, breach clause 3.2, or use the Service unlawfully.
6.2 For any other breach of this Agreement, we'll give you 14 days' written notice to fix the breach before we suspend or end your access, unless the breach can't reasonably be fixed.
7. Content and intellectual property
7.1 You grant Konker a non-exclusive, royalty-free licence to display, reproduce and adapt (for formatting purposes) the content you provide for your Listing across the Service, our marketing, and our social channels.
7.2 You confirm you have the right to grant this licence and that your content doesn't infringe anyone else's rights or applicable law. Konker retains all rights in the App, the Service and our own branding.
8. Data protection
8.1 Each party will comply with applicable data protection law in respect of personal data it processes under this Agreement. Details of how Konker handles personal data are set out in our Privacy Notice at konkerapp.com/policies.
9. Liability
9.1 Nothing in this Agreement excludes or limits either party's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.
9.2 Subject to clause 9.1, Konker's total liability to you arising out of or in connection with this Agreement is limited to the Fees you've paid to us in the 12 months before the event giving rise to the claim, and we are not liable for any indirect or consequential loss, or loss of profit, business, or opportunity.
10. General
10.1 This Agreement doesn't create a partnership, agency or joint venture between us. Neither party may assign this Agreement without the other's consent, except that Konker may assign it in connection with a sale of its business.
10.2 If any part of this Agreement is found unenforceable, the rest continues to apply. This Agreement, together with your order confirmation, is the entire agreement between us on this subject.
10.3 This Agreement is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
10.4 These terms are issued as Konker's current Provider Agreement and apply to your use of the Service from the date you accept them. We may issue updated terms, including following legal review, which will apply from the date we notify you and will not affect accrued rights or obligations under the version in place at the time.
